WA State Now Allowed to Recall and Destroy Marijuana Products

Emergency rules were adopted at the most recent meeting of the Liquor and Cannabis board regarding marijuana products containing pesticides and/or contaminants. Harsh penalties have been established for growers and producers making concentrates and edibles to make them more careful about what items are used to make products. The board is considering it as a recall mechanism for product safety and quality assurance.

In regards to the emergency rules, according to Seattle PI, the board said, “The emergency rules provide the ability to identify and remove products that have been found to pose a risk to public health in a fast and efficient manner. In addition the rules also provide licensees with the ability to withdraw products for reasons that are not related to public health risks, such as faulty packaging or aesthetic purposes.”

Some of the new pesticide rules are:

  • Pesticides must be approved by WSDA
  • Commercial fertilizers only to be used with WSDA approval
  • Commercially available soil, soil amendments and necessary growing media available
  • Prohibited chemicals

 

The new list of prohibited products includes:

  • Ancymidol
  • Chlormequat chloride
  • Clofencet
  • Colchicine
  • Colloidal silver
  • Daminozide
  • Dikegulac
  • Flumetralin
  • Flurpimidol
  • Paclobutrazol

The board created rules regarding the use of “Mr. Yuk” stickers on all edibles and liquid products. To protect industry workers, their birthdates are no longer required on worker ID badges. Rules were also created to discontinue unlicensed marijuana-business operations. Perhaps one of the biggest penalties is the permanent loss of license with no ability to reapply for failure to address monetary penalties two or more times in a three year period.
